Copyright and generative AI

Generative AI tools are being used to create beautiful, new works of art. The question becomes whether or not the laws will provide copyright protection for these newly generated works.

There are seemingly three issues that need to be addressed:

  1. whether AI-generated works are copyrightable
  2. who should be considered the author of such works
  3. when the process of training generative AI programs constitutes fair use

Submission

  • Please read this case and brief it. [30 points]
  • Read this report, Generative Artificial Intelligence and Copyright Law, and answer the following questions:
    • [20 points] – What are two reasons that AI generated works may not receive copyright protection. Please use examples cited in the report. Please back up your answer by citing the examples.
    • [20 points] – Describe arguments ChatGPT gives regarding copyright infringement and the training process, specifically regarding fair-use? See page 4. Please make sure to explain fair use. No more than one single spaced page here. Minimum one paragraph.
